  1. 1. Purpose and scope of the contract.

  2. The www.partybooker.ch website (hereinafter referred to as "Partybooker") is managed by Partybooker Christen-Bonvin SNC and shows details of active event organisation providers. These Terms and Conditions (hereinafter referred to as "GTC") are for providers and Internet users and regulate the registrations made by Partybooker for providers. The GTC can be viewed, printed or downloaded at any time: see the General Terms and Conditions page of the website www.partybooker.ch.


  1. 2. Arrangements for the purchase of the Partybooker service.

  2. The purchase of the Partybooker service and the creation of a service account is through the Partybooker site www.partybooker.ch.


  1. 3. Conclusion and termination of the contract.

  2. The contract between Partybooker and the provider starts from the moment the provider pays to register with Partybooker. The minimum duration of the contract is one year, ie 12 months. It is renewable for a further 12 months and is subject to termination by either party, such termination to be confirmed via the website www.partybooker.ch at least one month before the renewal date. Content responsibility

  1. The service provider is responsible for the content of his registration and undertakes to keep information and offers updated. Responsible for ensuring the conformity of the offer with the provisions relating to non-competition, advertising rights, intellectual property and other legal provisions in force in Switzerland.

  1. By confirming the registration, the service provider accepts to provide Partybooker with accurate and complete online data according to the standard form and, accepts their publication on the website www.partybooker.ch. The service provider undertakes to make available to Partybooker data’s and photos in the format according to the technical specifications. The development of promotional material is done by the provider and at his expense and remains under his responsibility. Partybooker reserves the right to exclude data’s or photos provided by the partner.

  1. For all means of payment, the provider accepts to provide accurate and correct data’s. The use of false data’s or the misuse of identity is considered fraud and is punishable by law within the meaning of Article 146, respectively of Article 147 of the CC and will be prosecuted.


  1. 4. Data Protection.

  1. Partybooker is committed to fulfilling its data protection obligations. All data submitted to Partybooker by providers and users remains strictly confidential. Partybooker Christen-Bonvin SNC is committed to compliance with and ethical behaviour based on the General Data Protection Regulations (GDPR) and other legislation currently in force. The data collected will be used only for the purpose of ensuring that the provider’s details are shown on the Partybooker site in accordance with the provider’s requirements. By subscribing to the Newsletter, customers agree that their data will be used to provide them with regular offers. Providers and users may require that all their data be deleted at any time.


  1. 5. Limitation of Partybooker's Responsibility.

  1. Partybooker makes every effort to ensure that the content of the site is up-to-date and reflects the provider’s current position. Partybooker cannot be held liable for any erroneous or obsolete data. The provider cannot be guaranteed exclusivity or location in a particular category and / or sub-category of the site www.partybooker.ch. Partybooker reserves the right to block access to the site temporarily to perform maintenance necessary for proper operation. Partybooker cannot be held responsible for any technical problems related to the hosting of its site. Partybooker's liability is limited to cases of wilful misconduct or gross negligence. Partybooker cannot be held responsible for the content, commercial activities, products and services offered through those sites to which hypertext links, direct or indirect, are made. In the event that Partybooker has performed its services only partially or in a manner that does not comply with the contract, the compensation awarded by Partybooker will not exceed the annual amount received by Partybooker in respect of the said contract. Any liability of Partybooker for possible additional or indirect damages is expressly excluded.


  1. 6. Billing and payment.

  1. Providers are invoiced for registration on the Partybooker site in the form of a single annual amount. Payment is to be made directly by Paypal on the Partybooker website or by bank transfer within 30 days of receipt of invoice. The posting on the website www.partybooker.ch will take place when the invoice is paid and the announcement will be approved by the Partybooker Associates. All sales prices are in Swiss Francs (CHF) and do not include value added tax (VAT). The price indicated on the site www.partybooker.ch at the time the order is placed is the price to be paid in respect of the contract. If the provider has not fulfilled its obligations or only partially fulfilled them, that provider remains liable for the full annual amount of the contract payment. Any site downtime when registration details do not appear and / or a promotion is not posted on the site due to a delay in the delivery of images or information is at the provider’s risk. The prices listed on Partybooker price lists do not include production costs. Partybooker reserves the right to modify its rates at any time. The new rates come into effect when renewing the annual contract. The provider has one month from receipt of the new conditions to terminate the contract.


  1. 7. Contract amendment, addition or termination to be in writing.

  2. Any amendment, addition or termination of any contract or of these terms and conditions by either party must be in writing. If any of the provisions of the contract or these terms and conditions should be or become invalid, this does not affect the validity of other provisions. Partybooker reserves the right to modify these terms and conditions at any time. Such modifications will be published and can be consulted on the website www.partybooker.ch.


  1. 8. Coming into force.

  1. These Terms and Conditions (GTC) come into force on June 26, 2019.


  1. 9. Applicable law and jurisdiction.

  1. These Terms and Conditions (GTC) are governed by Swiss law. The exclusive place of jurisdiction is Nyon (Vaud).

  1. SAV order tracking: All inquiries regarding registrations and their follow-up will be handled by Partybooker Partners Christen-Bonvin SNC on the website www.partybooker.ch. Partybooker is available to all its service providers / Internet users / potential service providers for all enquiries relating to the functioning of its website, possible technical problems, or any other requests.
